User Agreement, Terms and Conditions IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY AS IT WILL AFFECT ANY RIGHTS YOU MAY HAVE. THE AGREEMENT REQUIRES THE USE OF INDIVIDUAL ARBITRATION RATHER THAN JURY TRIALS OR CLASS ACTIONS TO RESOLVE DISPUTES AND CLAIMS (INCLUDING THOSE ALREADY SUBJECT TO LITIGATION). ARBITRATION IS MORE INFORMAL THAN LITIGATION BECAUSE IT USES A NEUTRAL ARBITRATOR INSTEAD OF A JUDGE OR JURY AND ALLOWS FOR LESS DISCOVERY AND REVIEW OF APPEALS THAN IN COURT. THE ARBITRATION IS BINDING AND SUBJECT TO VERY LIMITED REVIEW BY A COURT. THIS ARBITRATION CLAUSE SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT. Parties to the Agreement.The parties to this User Agreement are You and Latinos Remesas. As used in this User Agreement, the terms "Latinos Remesas", "we", "us" and "our" refer to Saint River Services Corp, with its employees, consultants, directors, successors, subsidiaries, affiliates and assignees (collectively known as "Latinos Remesas"). The terms "You" and "Your" refer to users of the Service, whether as senders, recipients, or visitors to our stores or websites. Scope of agreement. This User Agreement governs all interactions between Latinos Remesas and you,1. General description of the service A. The service and where the service is performed. IMPORTANT: All activities conducted in connection with the Service will be deemed to be conducted in Florida. B. Use of the service is a binding agreement. You must not access or use the Service if you do not agree to be bound by the terms of this User Agreement. By accessing and using the Service, you agree to the terms of this User Agreement. C. Intent to Serve.The Service is intended for our customers to send money transfers or pay bills to family and friends. We recommend that you use the service only to send money to pay bills to people you know personally. You should never use the Service to send money or pay bills to strangers. D. Consumer Fraud Alert: Protect yourself against fraud and scams. You should only send money to people you know or pay bills for people you know, send money on your behalf and not on behalf of others. and use the services of Latinos Remesas only for lawful activities.Please let us know immediately if you think someone is trying to scam or scam you by contacting us at info@latinosremesas.com. 2. Definitions The Service allows people to send and receive money and pay bills around the world. For this purpose: A. "Sender" means someone who uses the Service to send money. B. "Recipient" means a person who receives money from a Sender through the Service or someone for whom a Sender makes a bill payment through the Service.For example, and for illustrative purposes only, if you use the Service to pay a family member's electricity bill, you are the sender, your family member is your recipient, and the electric company receiving the payment is the utility company for that transaction. . The person referred to as " is the amount that the Sender gives to Latinos Remittances to send the transaction. I. "Payment instrument" is a printed or electronic means or other means used to initiate the transfer of funds. Payment instruments include instructions to transfer funds (in particular, payment documents) and electronic means of payment.Payment instruments include Your credit card, debit card or bank account, but not prepaid payment cards. J. "Payment Amount" is the amount paid to the Recipient or service company, excluding any taxes or charges that may apply under the laws of the receiving country (the "Local Taxes"). 3. Service Access A. Eligible Users. You must be at least eighteen years of age to access or use the Service as a Referrer. You must be able to form legally binding contracts under applicable law. Other restrictions may apply. B. Users must provide accurate information.The Sender acknowledges and agrees that it will provide Latinos Remesas with true, accurate, current and complete information. Sender acknowledges and agrees that money may not be recoverable if deposited into the wrong account. C. No Prohibited Activity. You agree that you will not use Latinos Remesas money transfer services for or in connection with any prohibited activity. D. No change in transaction details. We generally do not allow the details of Your Transaction to be changed after it has been processed. We rely on the information you have provided and it is your responsibility to ensure that your transaction details are correct for processing. E. Bill Payments.It is declared that Your Recipient has authorized You to have access to Your account information and allow Latinos Remesas to collect and verify information about Your Recipient. F. Not available to certain users. The Service may not be available in whole or in part in different countries and jurisdictions as determined by local laws and regulations. 4. Payments If you request a transaction, it is an offer that we may accept or reject at our discretion. A. Charges. For each transaction you submit, you agree to pay a transaction fee, plus the number of transactions. Additional charges may apply.Payment in US dollars is only due at the time Your Transaction is submitted for processing. If you submit a transaction that ends up charging Latinos Remesas an insufficient funds fee, return fees, or other similar fees, you agree to refund all fees immediately upon request.For transactions funded from the Sender's bank account, You agree that Latinos Remittances may debit Your bank account from time to time for less than the amount of the transfer (for example, for a transfer of $500, Latinos Remittances may debit $499. B. Authorization In order for us to charge you, you authorize us to access, charge or debit funds from any of the Payment Instruments you provide to us in connection with your use of the Service, including, for example, your credit card, debit card or bank account We do not accept prepaid cards as a payment instrument. If your payment fails or is insufficient, we may retry to debit your Payment Instrument one or more times or you may authorize us to attempt to debit a different Payment Instrument. For example,If there are insufficient funds in Your bank account at the time You submit Your Transaction, We may attempt to debit Your bank account or charge Your credit card at a later time. You represent and warrant that you are the legal owner of your payment instruments. C. Other charges for which you may be responsible. Latinos Remesas is not responsible for any fees or charges that may be imposed by financial institutions associated with your payment instruments. For example (and without limitation), your credit card issuer may charge you an up-front cash fee and interest if you use a credit card as payment.Latinos Remesas is not responsible for such fees, nor are we responsible for any non-sufficient funds fees, return fees, or other similar charges that your credit card issuing bank or other provider may impose on you in connection with your use of the Service. . D. Coins. Latinos Remesas receives all currencies exchanged under the money transfer service at an exchange rate. The currency is offered to the sender at an exchange rate specified on the receipt, and the Trustee will receive the amount of foreign currency specified on the receipt. Any difference between the currency exchange rate offered to the Sender and the currency exchange rate received by Latinos Remesas is owned by Latinos Remesas.If the Recipient chooses to receive a currency other than His Receipt, Latinos Remesas is not responsible for the exchange rate applied. E. Currency confirmation. Latinos Remittances and its service providers generally make money when you pay for a transaction in one currency and the transaction is paid for in another currency, which is based on the difference between the exchange rate at which we purchase foreign currency and the exchange rate we provide to you. your.You agree, when you send a Transaction to the Receiver's bank account, that the bank account is denominated in the same currency as the Transaction (for example, if Your Transaction requires Latinos Remittances to deposit pesos into the Receiver's bank account, then You confirm that the Recipient's bank account is denominated in pesos). 5. Transaction Payments A. Appointment of Agent. We work with service providers to pay funds to Recipients and service companies. You, as the Sender, designate Your Recipient as Your agent for the purpose of receiving funds in connection with the Service. B. Hours of Service Providers.We try to provide up-to-date information on our websites regarding the location, availability and hours of our service providers. However, you agree that Latinos Remesas is not responsible for any inaccurate or incomplete information that may be posted on its websites. C. Verification. Recipients may be required to prove Your identity prior to receiving funds by presenting valid and current identification documents from a list of acceptable forms of identification. In addition, Recipients may be required to provide a Transaction number and/or other similar identifier associated with Your Transaction. D. Data Collection, Storage, and Accuracy.You give Latinos Remesas permission to communicate with your Recipient or the Service Company and store all data that is necessary to provide the Service. Please verify that your account information and bank details are correct before submitting your Transaction because Latinos Remittances is not responsible for any inaccuracies. If the account information and bank details are incorrect, the money may be sent to the wrong bank account and may not be recoverable. 6. Restrictions and conditions A.General. _ We may, at any time and in our sole discretion, reject any Transaction or limit the amount to be transferred, either per Transaction or in its entirety without prior notice.Any of these limits may be imposed on individual or related accounts or households, at the sole discretion of Latinos Remesas. We reserve the right at any time, and from time to time, to modify or discontinue the Service (or any part thereof) with or without notice. B. Delays. Your Transaction may be delayed or canceled at any time before the Receiver or service company receives the payment amount, without notice. We may delay or cancel Your Transaction for reasons including, but not limited to: identity verification; validation of your transaction instructions and payment instruments; anti-money laundering and anti-fraud compliance review;contact and locate You, Your Recipient, the service company or Your Recipient; and to comply with applicable law. Business hours, system availability, and currency availability of our service providers may also cause delays. C. Business Transactions. You agree that you will only use the Service to send money to people or Recipients you know personally and for personal reasons. If Latinos Remesas discovers that you are using the Service for commercial purposes, including (but not limited to) purchasing goods or paying for services other than payments made to Service Companies specifically provided by the Service, we may, in our sole discretion, cancel Your Transaction.D. Unauthorized Transactions. You may not use the Service in violation of this User Agreement or any applicable laws, rules or regulations. It is a violation of this User Agreement to use the Service for any of the following activities (without limitation): sexually oriented materials or services, gambling activities, fraud, money laundering, financing of terrorist organizations, purchase or sale of tobacco, firearms, prescription drugs or other controlled substances, or the sending of money to or by a Recipient who has violated the User Agreement. If you use the Service in connection with illegal conduct, Latinos Remesas reserves the right to report it to the appropriate law enforcement agency or agencies.E. Reservation of Rights. We may, in our sole discretion, cancel any Transaction that we suspect is being used for any purpose prohibited by this User Agreement, including business purposes (such as purchases of goods or payment for services of any kind). You acknowledge that Latinos Remesas is not responsible for your use of the Service in violation of this User Agreement, including all risks associated with the purchase of goods or payment for services of any kind, including (without limitation) any losses you suffer from undelivered goods. or defective and the services you pay for using the Service. F. Ineligibility. Not all payment instruments are available to all customers at all times.We may, in our sole discretion, decline Transactions funded by certain Payment Instruments. We may, in our sole discretion, reject Transactions from certain Senders, certain Recipients, or certain Recipients or Service Companies, including, without limitation, entities and individuals that are included on the list of Specially Designated Nationals, the list of Non-Cooperative Countries and Territories , and any other list that may be issued from time to time by the United States Department of the Treasury and other government agencies. G. You must act for yourself. You may not send or receive a Transaction (i) on behalf of another person, (ii) on behalf of a company or other non-human entity,or (iii) on behalf of a charity without the express consent of Latinos Remesas. You can send transactions to Recipient service companies that you know personally. We may, at any time and in our sole discretion, (i) decline any Transaction or (ii) close multiple accounts of a person, persons related to the person, or persons living in the same household as the person. H. No change. We generally do not allow you to change the details of your Transaction once we have completed processing it. We rely on the information you provide and it is your responsibility to ensure that your transaction details are correct prior to processing. I. Restricted Activities.As a user of our websites or Service or in the course of your interactions with Latinos Remesas, you may not: (i) breach this User Agreement or any other agreement between you and Latinos Remesas; (ii) Provide false, inaccurate or misleading information; (iii) refuse to cooperate in an investigation or provide confirmation of your identity or any information you provide to us; (iv) Use an anonymity proxy; (v) provide you with a cash advance from your credit card (or help others to do so);(vi) Sharing Transaction numbers or information with anyone other than the Service Company, Your Recipient or Recipient (and will advise Your Recipient or Recipient not to share Transaction numbers or information); 7. Dispute Resolution: Agreement to Arbitrate Disputes A. Agreement to Arbitrate Disputes. This section of the User Agreement shall be referred to as the "Agreement to Arbitrate Disputes." This Agreement to Arbitrate Disputes shall be deemed a contract under the law of the State of Florida and shall be governed by the laws of the State of Florida in conjunction with the Federal Arbitration Act ("FAA") (9 USC §§ 1-16 ). B. Time of acceptance of the dispute arbitration agreement.Your agreement with Latinos Remesas to arbitrate disputes begins when you accept the terms and conditions of this User Agreement. You agree to the terms and conditions of the User Agreement by: (i) receiving this User Agreement and the Agreement to Arbitrate Disputes and not unsubscribing within 14 days of receiving the Agreement; (ii) give us a written or electronic signature, or tell us verbally that you agree; (ii) (iii) use the Service; (iv) Send a payment through the Service as a Sender; (v) Receive a Payment using the Service as a Recipient; or (vi) Pay for the Service. C. Effect of Acceptance.ONCE ACCEPTED, THIS AGREEMENT TO ARBITRATE DISPUTES APPLIES TO ALL DISPUTES BETWEEN YOU AND LATINOS REMESES REGARDLESS OF WHEN THE CIRCUMSTANCES GIVING RISE TO THE DISPUTE OCCURRED. If you have any questions, please contact the Latinos Remesas Customer Service Department for answers to your questions. D. Presentation of Pre-Arbitration Disputes. Before taking any formal action, you agree to contact us in writing and provide a description of your dispute, all relevant documents, and the proposed resolution.If we are unable to resolve your dispute within 30 days of your notice, you agree to submit your dispute to binding arbitration or small claims court as provided in this provision. ARBITRATION IS MORE INFORMAL THAN LITIGATION BECAUSE IT USES A NEUTRAL ARBITRATOR INSTEAD OF A JUDGE OR JURY AND ALLOWS FOR LESS LEGAL DISCOVERY AND APPELLATE REVIEW THAN IN COURT.THE ARBITRATION IS BINDING AND SUBJECT TO VERY LIMITED REVIEW BY A COURT. THIS ARBITRATION CLAUSE SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT. YOU AGREE THAT YOU ARE AWARE THAT THERE IS NO JUDGE OR JURY IN ARBITRATION, BUT THAT AN ARBITRATOR MAY AWARD YOU THE SAME DAMAGES AND REMEDIES THAT YOU MAY RECOVER IN A COURT OF LAW, SUBJECT TO THE LIMITATION OF LIABILITY IN SECTION 9 OF THIS AGREEMENT. . YOU AND INTERMEX FURTHER AGREE THAT THE ARBITRATOR SHOULD HONOR THE TERMS OF THIS AGREEMENT.NOTWITHSTANDING THE FOREGOING, PROVIDED THAT SUCH ACTION IS WITHIN APPLICABLE JURISDICTIONAL LIMITATIONS, EITHER PARTY MAY BRING A CLAIM INDIVIDUALLY IN SMALL CLAIMS COURT OR THE SMALL CLAIMS DIVISION OF A COURT OF APPROPRIATE JURISDICTION. F. Claims Covered by the Dispute Arbitration Agreement. This Agreement to Arbitrate Disputes is intended to cover all disputes or claims (whether based on contracts, torts, federal law, including, but not limited to, the Telephone Consumer Protection Act, the Fair Debt Billing Practices Act , Fair Credit Reporting Act, Fair and Accurate Credit Transactions Act, state statute, state common law, fraud, misrepresentation,or any other legal or equitable theory) arising out of Your relationship with Latinos Remittances and/or any interaction between You and Latinos Remittances, including, without limitation, all disputes or claims arising out of or related to the Service. References to you and Latinos Remesas include our respective suppliers, vendors or service providers, service companies or their respective subsidiaries G. Ruptura. If any term of this Agreement to Arbitrate Disputes is to any extent invalid, illegal or unenforceable, such term will be severed to the extent of such invalidity, illegality or unenforceability; all other terms hereof will remain in full force and effect. H. Types of Relief.All claims between you and Latinos Remesas, including claims for monetary damages or for any type of injunctive, declaratory or non-monetary relief, will be resolved by binding arbitration where permitted by law. I. Disposition of the delegation. You and Latinos Remesas agree that the Arbitrator will have the power to decide on the arbitrator's own jurisdiction, existence, scope, validity and arbitrability of this Agreement. This Delegation Provision shall be deemed a contract under the law of the State of Florida and shall be governed by the laws of the State of Florida in conjunction with the Federal Arbitration Act (FAA).Your agreement with Latinos Remesas to be bound by this Delegation Provision begins when you accept the terms and conditions of this User Agreement. J. Sole Arbitrator. Claims will be heard by a single arbitrator. K. There is no class action in the arbitration. You and Latinos Remesas agree that any arbitration will take place on an individual and non-consolidated, class or representative basis. In addition, you and Latinos Remesas agree that the arbitrator may not consolidate the proceedings or claims of more than one person and may not preside over a class or representative proceeding.Each party waives the right to litigate in court or arbitrate any claim or dispute as a class action, whether as a class member or representative, or to act as a private attorney general. If there is a final judicial determination that applicable law precludes the application of the limitations in this paragraph to a particular claim for relief, L. AAA Rules. Arbitration of any dispute or claim shall be conducted in accordance with the American Arbitration Association's Consumer Arbitration Rules ("Absent a determination that your claim is frivolous, brought for an improper purpose, or malicious under the rules of Federal Rule of Civil Procedure 11(b), Latinos Remesas will pay the costs of filing, administering, and arbitrating an arbitration. initiated pursuant to this Agreement.
